Terms & Conditions
This page is a courtesy English translation. The German-language Allgemeine Geschäftsbedingungen is the legally binding version under Austrian law.
1. General
These "Terms and Conditions" apply to all legal transactions with clients, take effect upon arranging an appointment by phone or email, and may only be changed by written individual agreement. No other general terms and conditions apply. "Seiler-Shiatsu" reserves the right to amend these Terms and Conditions; the version in force at the time the contract is concluded, as published on www.seiler-shiatsu.at, is decisive.
2. Prices
Services rendered are to be paid in full, without deduction, into the specified bank account within 7 business days of receiving the invoice. A refund of services paid for in advance, such as vouchers or subscriptions, is not possible.
These terms are accepted and take effect upon placing an order.
3. Appointments
Appointments can be arranged by email, phone, or via the online booking portal on the website. Appointment requests made by email or online booking are only considered confirmed once acknowledged by a reply email from Seiler Shiatsu. Arriving late for an agreed appointment may, in the interest of subsequent clients, result in a shortened treatment time. The full treatment price as agreed will be invoiced. No price reduction can be granted for a shortened treatment requested by the client during the session.
4. Cancellation policy
Appointments that cannot be kept must be cancelled in writing or by phone at least 48 hours in advance; otherwise, please understand that the full fee will be charged for late cancellations or no-shows.
5. Vouchers and discount promotions
Vouchers are handed over in person or sent by post to a specified address. The cost for voucher postage and processing is € 4.50. Agreed voucher prices are to be paid in cash upon collection at the practice, or, in the case of postal delivery, transferred together with the € 4.50 fee to the specified account within 7 business days. Seiler Shiatsu will only redeem vouchers that have been paid in full. Seiler Shiatsu accepts no liability for vouchers delivered late and any resulting damages. Should a voucher not arrive within 5 business days of dispatch, the client must notify Seiler Shiatsu immediately, and no later than 2 weeks after ordering.
Should the client fail to notify Seiler Shiatsu within 2 weeks of the voucher order that the voucher has not arrived, Seiler Shiatsu accepts no obligation to provide a refund.
Seiler Shiatsu reserves the right, following a price increase, to charge the voucher holder the increased price difference for a treatment, even if the content of the treatment remains the same.
To redeem a voucher, please mention it when arranging the appointment and bring it with you to the session.
Should the agreed appointment need to be cancelled, this must be done in accordance with the deadlines stated under point 4 (Cancellation policy).
If the appointment is not cancelled within the deadlines stated under point 4 (Cancellation policy), the voucher is considered redeemed and loses its validity.
A voucher is valid for 12 months from its date of issue. If no issue date is noted, the date of payment for the voucher applies. Due to price calculations, redeeming a voucher beyond its one-year validity period is not possible. Should a different agreement be reached extending beyond the validity period, Seiler Shiatsu may adjust the voucher's value according to its age. Relocation of the practice is not grounds for a voucher payout. A cash payout of the voucher value is excluded.
Discount promotions cannot generally be combined with other discount promotions or vouchers.
6. Basic information / services
Shiatsu is a regulated trade in Austria (classified under the masseur trade) and, in keeping with the nature of this commercial activity, works in the preventive domain to support wellbeing, balance, the flow of energy, and the body's self-healing capacities.
Shiatsu is therefore not a medical profession and is not a substitute for medical, psychiatric, psychotherapeutic, or other therapeutic assessment and treatment. Where physical and/or psychological complaints, illnesses, or injuries are present, medical and/or therapeutic assessment and treatment are important, and Shiatsu sessions may in these cases only take place after consultation with your doctor or therapist.
All treatments provided by the Shiatsu practitioner take place in agreement with the client, who commits to providing truthful information about their state of health and the effects of treatment to the practitioner. The client commits to independently reporting, before every treatment, any changes to their state of health. All information obtained in the course of treatment is subject to the practitioner's statutory duty of confidentiality.
7. Disclaimer of liability
The energetic Shiatsu treatment serves exclusively to promote health, relaxation, and the activation of self-healing capacities. It is not a substitute for medical diagnosis, advice, or therapy. Ongoing medical treatment, medication, or therapy should never be interrupted or discontinued without consulting the treating doctor.
Clients are obliged to inform me truthfully, before treatment begins, of any existing physical or psychological complaints, pre-existing conditions, acute ailments, allergies, pressure-sensitive skin, or an existing pregnancy. Changes in health status during the course of treatment must be reported to me without being asked.
Liability for any damages arising from non-compliance with these Terms and Conditions, or from the client's own fault, is excluded. Any knowledge applied from workshops does not give rise to a claim of liability against me.
Should consequential damages occur despite competent treatment, resulting from a client knowingly or unknowingly withholding relevant exclusion criteria or pre-existing conditions, I am released from all liability. The same applies to damages arising because an exclusion criterion was neither known to the client nor recognisable to me.
No liability is accepted for the loss of or damage to clothing, valuables, or cash brought to the practice.
This website has been compiled with the greatest possible care. The author is not liable for damages arising from the use of or access to data, content, or from computer viruses. Seiler Shiatsu expressly reserves the right to change or add to parts of the website or the entire offering without separate notice.
No cease-and-desist without prior contact: should content on this website infringe the rights of third parties or statutory provisions, please provide brief, cost-free notice, and I guarantee to promptly remove any rightfully objected-to passages without the need to engage legal counsel. Costs incurred without prior contact will be rejected.
8. Changes to the event programme / venue
Due to long-term planning, organisationally necessitated changes to the programme are possible. I reserve the right to change appointments, start times, workshop locations, and organisational procedures. This gives the participant no right to withdraw or to a reduction in cost.
9. Responsibility
Participation in courses and seminars is undertaken on one's own responsibility and at one's own risk. It is not a substitute for medical treatment. Every workshop participant confirms that they are physically fit and are not concealing any illnesses.
10. Place of performance
Treatments are carried out in Baden near Vienna.
11. Data protection
Data transmitted to Seiler Shiatsu, such as name, address, phone number, or email address (personal data), is used exclusively for the purpose of processing your enquiries. Your data will not be passed on to third parties.
12. Applicable law / jurisdiction
The place of jurisdiction is Baden near Vienna, Austria. Austrian law applies.
13. Final provisions
The court with subject-matter jurisdiction at the seat of my business shall have local jurisdiction to decide all disputes arising from this contract. Any agreements deviating from these "Terms and Conditions" must be made in writing.
